Sitter Media Release
Last updated:
This is the public version of the release a sitter agrees to during onboarding. Anyone — including a sitter thinking about signing up — can read it here before they get to the consent step. Nothing on this page signs you up. The actual agreement happens inside the onboarding flow.
This is a working release. [Brand] is in pre-launch. We update it as the platform develops. Your continued use after we update means you accept the updated version.
The short version
We use your intro video and any profile photos to show families who you are. By submitting your video to us, you give us broad permission to use it in connection with the platform. You can ask us to take down your active profile any time, but we won’t be able to recall copies already shown or stored.
The numbered sections below are the full text. Skim the headings; read what matters to you.
1. What this release is
This is a permissions agreement. It covers the 2-minute self-recorded intro video that every sitter records before they can be listed on [Brand], and any profile photos a sitter uploads. You agree to it once, during sitter onboarding. This public page exists so you can read what you will be asked to agree to before you start. There is no sign button on this page.
By uploading any media to your sitter profile, you accept this release as written, and you agree to any future version.
2. About this release
This section is here because this release is between [Brand] and you as an off-duty individual — not between [Brand] and the employer you work for in your day job.
Sitters listed on [Brand] are independent contractors, not employees of [Brand TBD] LLC or [Brand]. They are off-duty professionals — a registered behavior technician, direct support professional, paraeducator, or special education teacher in their day job — who choose to spend personal hours as a qualified sitter through this platform. Sitters do not perform their day-job work through [Brand]. They provide companionship and supervision only. They do not deliver applied behavior analysis, behavior plans, habilitation, special education instruction, IEP supports, or therapeutic services through this platform. They do not administer medications. They do not write session notes or progress logs. They are not supervised by their day-job employer when working as a sitter through us.
3. What media this release covers
This release covers anything you upload, send to us, record on the platform, or otherwise provide as part of your sitter profile or any platform feature, now or in the future. Including but not limited to: the required intro video, profile photos, audio, written bio, demonstration clips, badges, and any subsequent or updated version you submit.
4. Your license to us
When you submit media to us, you grant [Brand TBD] LLC a worldwide, perpetual, irrevocable, royalty-free, fully paid-up, sublicensable, and transferable license to host, store, copy, modify, edit, crop, caption, translate, adapt, combine with other content, display, perform, publish, transmit, and distribute your media — in any medium now known or later invented — for any purpose related to operating, promoting, marketing, improving, or expanding the platform. This includes use on our website, our mobile apps, in family-facing matching surfaces, in advertising for the platform, in social media operated by us, and in materials shared with partners. We don’t have to credit you, and we may use or not use the media as we judge best. Our affiliates, successors, assigns, and acquirers inherit this license.
5. What this license does not cover
We won’t sell your raw media to a third party as a standalone product. We won’t intentionally use the media to misrepresent what you said or did. We won’t hand the media to your day-job employer just because they asked.
6. What you represent
By submitting media, you represent that: (a) you are the only identifiable person in the media, or you have written permission from anyone else identifiable; (b) no minor appears in the media; (c) no logo, uniform, or workplace setting of your day-job employer is shown in a way that could imply endorsement; (d) the recording does not include another person’s voice or likeness without their permission; (e) you have all rights necessary to grant the license in section 4; (f) you are not breaching any contract or duty by giving us this license; (g) the media does not infringe anyone’s copyright, trademark, right of publicity, privacy, or any other right; and (h) the media is not defamatory, unlawful, obscene, or harassing. If a claim arises from your media, you’ll defend and indemnify [Brand TBD] LLC from it, including reasonable attorneys’ fees.
7. Retention
We keep your media while your profile is active and as long as we reasonably need it afterward — for example, to handle reactivation requests, to respond to disputes, to enforce our policies, or to comply with law. Backup copies follow the schedule in our Privacy Policy. We don’t promise a specific deletion date.
8. How to revoke this release
You can ask us to stop using your media going forward at any time, by emailing hello@example.com or by deleting your profile in the app. We’ll process your request as we are able — we don’t promise a specific window. Revocation applies to future use only. We have no obligation to retrieve, recall, or modify copies already in use, already in family-facing surfaces, already in cached or archived form, or already in materials shared with partners. Once we have stopped using the media going forward, we may still keep copies to enforce our policies, defend claims, or as required by law.
9. What this release is not
- This is not your contract with [Brand]. The terms that govern your work as a sitter are in the Independent Contractor Agreement, which is a separate document.
- This is not a privacy policy. How we handle every piece of data on the platform is covered in the Privacy Policy.
- This release does not grant any rights in your likeness for use outside [Brand]. Your likeness is your own; this document only gives us permission for the uses listed in Section 4.
- This release does not waive any other right we have to remove your profile, delist you, or end your sitter status.
10. Governing law and disputes
This release is governed by Idaho law. Any dispute about this release is brought in Ada County, Idaho. You waive any objection to that venue. To the extent the law allows, you waive any moral rights you may have in the media. If any part of this release is unenforceable, the rest stays in effect.
11. Changes and acceptance
We may change this release any time. The current version is the one posted on this page. You accept the current version when you upload media or use platform features that present media to families.
